Our online store is powered by Shopify, which enables us to provide the Services to you.

When using the Services or purchasing products, you may be asked to provide information including your name, email address, billing information, payment information, and shipping address.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.
SECTION 2 - OUR PRODUCTS
The Old Factory Coffee Co. offers coffee, apparel, drinkware, accessories, and other merchandise.
We make reasonable efforts to accurately display and describe our products. However, product colors, packaging, printing, embroidery, positioning, dimensions, and appearance may vary slightly from photographs or digital representations due to manufacturing processes, product variations, device displays, and screen settings.
Coffee products may also experience natural variations in appearance, aroma, and flavor.
We do not guarantee that the appearance of a product will be identical to its digital representation.
Product descriptions, pricing, packaging, availability, and specifications may change without notice. We reserve the right to discontinue products or limit quantities at any time.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase products from The Old Factory Coffee Co. LLC.
We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including in cases involving suspected fraud, pricing or inventory errors, product availability, payment problems, or other circumstances affecting our ability to fulfill an order.
Your order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.
Please carefully review your order before submitting it.
Many of our products are roasted, prepared, printed, embroidered, or otherwise produced specifically to fulfill customer orders. As a result, production may begin shortly after an order is submitted.

We will make reasonable efforts to accommodate your request, but we cannot guarantee that an order can be changed or canceled after fulfillment or production has begun.
Returns, refunds, replacements, and exchanges are governed by our Return & Refund Policy.
Products purchased through our consumer store are intended for personal or household use unless otherwise agreed to by The Old Factory Coffee Co. LLC.
SECTION 4 - PRICES AND BILLING
Prices, discounts, product availability, and promotions may change without notice.
The price charged for a product will be the price displayed at the time the order is placed, subject to correction of obvious pricing or technical errors.
Unless expressly stated otherwise, listed prices do not include applicable taxes, shipping charges, customs duties, import fees, or other charges that may apply.
You agree to provide current, complete, and accurate billing, payment, shipping, and account information.
You represent that you are authorized to use any payment method submitted for a purchase and agree to pay all charges associated with your order.
SECTION 5 - SHIPPING AND DELIVERY
Shipping and delivery dates provided through our Services are estimates and are not guaranteed.
Some products within the same order may be produced and fulfilled separately. As a result, an order containing coffee and merchandise, or products produced by different fulfillment facilities, may arrive in multiple packages and at different times.
You will not necessarily receive every item in your order in the same shipment.
We are not responsible for shipping delays caused by carriers, severe weather, customs processing, incorrect or incomplete customer information, or circumstances outside our reasonable control.
Customers are responsible for providing an accurate and complete shipping address.
If you discover an error in your shipping information, please contact us immediately. We cannot guarantee that an address can be changed once an order has entered production or shipment.

SECTION 6 - INTELLECTUAL PROPERTY
The Services and their contents, including without limitation The Old Factory Coffee Co. name, logos, branding, product names, coffee names, slogans, designs, graphics, photographs, illustrations, text, video, audio, website design, and other materials, are owned by or licensed to The Old Factory Coffee Co. LLC and are protected by applicable intellectual property laws.
This includes, where applicable, branding associated with products and collections such as Factory House, First Shift, Rusty Rails, and After Hours.
The Services are provided for personal, non-commercial use.
You may not reproduce, distribute, modify, republish, sell, exploit, create derivative works from, or otherwise use our protected materials without prior written permission from The Old Factory Coffee Co. LLC, except as permitted by law.
Nothing contained in these Terms grants you a license or ownership interest in intellectual property belonging to The Old Factory Coffee Co. LLC, Shopify, or any third party.
All rights not expressly granted are reserved.
SECTION 7 - OPTIONAL TOOLS
We may provide access to tools, applications, integrations, or services operated by third parties.
We may not monitor or control these third-party tools and provide access to them “as is” and “as available” without warranties, representations, or endorsements.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
The Old Factory Coffee Co. is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Old Factory Coffee Co.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Old Factory Coffee Co., including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Old Factory Coffee Co.

You grant The Old Factory Coffee Co. LLC a worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display Feedback for purposes including operating, improving, and promoting our business and Services.
You agree not to submit unlawful, abusive, defamatory, fraudulent, infringing, obscene, or malicious content.
You remain responsible for the accuracy and legality of content you submit.

Occasionally, information on our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times, or other information.
We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted.
If an order is canceled after payment because of such an error, any applicable payment will be refunded.

LLC, ITS AFFILIATES, PARTNERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND SHOPIFY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR SIMILAR DAMAGES.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Old Factory Coffee Co. LLC, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, losses, and reasonable legal expenses arising from your violation of these Terms, applicable law, or the rights of another party.

The remaining provisions will continue in full force and effect.
